Injured as a Passenger: What Travelers Should Know After a Taxi or Rideshare Collision Being a passenger feels like the safest way to move through an unfamiliar city. Someone else is driving, someone else knows the roads, and the trip lasts twenty minutes. It is also the position that leaves a traveler with the least information if something goes wrong. A passenger did not choose the route, cannot see the dashboard, has no idea who insures the car, and in Florida may not realize that the way the ride was arranged has already decided what medical coverage exists. Florida Treats a Cab and an App Ride as Different Animals This is the part visitors find hardest to believe, and it is written into the statute rather than left to interpretation. Florida's rideshare law defines a "prearranged ride" to expressly exclude a taxicab or street hail service, and it states that a transportation network company and its drivers are not common carriers, contract carriers or motor carriers and do not provide taxicab service. Two vehicles can pull up to the same curb, carry the same passenger to the same hotel, and sit in entirely different legal categories. The line is drawn at how the ride began Hailing on the street, or taking the next car in a stand queue, is a street hail. Requesting through an app is a prearranged ride. The distinction has nothing to do with the vehicle's quality or the driver's experience, and everything to do with which chapter of Florida law governs the aftermath. Booked airport cars, hotel vans and limousines form a third group again, licensed as for-hire vehicles and insured commercially, which is worth knowing when a resort arranges the transfer on your behalf and you never see the paperwork. The Coverage Rule Most Visitors Assume Applies Florida is a no-fault state, so travelers reasonably expect personal injury protection to pay initial medical bills regardless of who caused the crash. For a private car, that is right. Section 627.733 requires owners of vehicles registered in Florida to maintain that security, with school buses and limousines carved out. Then comes the subsection almost nobody expects. The taxicab exception The same statute provides that the owner of a vehicle used as a taxicab is not governed by the general requirement at all. Instead, that owner satisfies financial responsibility under Section 324.032, and the statute adds that Section 627.737 does not apply to a taxicab. Both halves matter. Section 324.032 sets liability limits for taxicabs, limousines, jitneys and other for-hire passenger vehicles at $125,000 per person, $250,000 per incident, and $50,000 for property damage, well above what a private motorist must carry. And Section 627.737 is the provision that normally requires a permanent injury or similar threshold before an injured person can pursue pain and suffering. Its removal means a taxi passenger is not held to that gate. The trade-off is real: potentially no no-fault benefits paying the first medical bills, but higher liability limits and an easier path to non-economic damages. If You Booked Through an App Instead Section 627.748 sets the requirements in two tiers, and the tier depends on what the driver was doing at impact. Logged on to the network but not carrying a passenger, the driver's coverage must provide at least $50,000 for bodily injury per person, $100,000 per incident and $25,000 in property damage, plus personal injury protection at the statutory minimum and uninsured motorist coverage. Engaged in a prearranged ride, the requirement rises to at least $1 million for death, bodily injury and property damage, with personal injury protection at limousine minimums. The status is proven by the company, not the driver A passenger already in the car is plainly on a prearranged ride, but the question sharpens when the crash involves another vehicle whose driver was also working. Whether that person was logged on, and whether they had accepted a fare sits in platform records rather than in anyone's memory. A Passenger's Position Is Unusually Strong According to Matthew A. Rabin, Partner and Managing Attorney of RTRLAW's personal injury litigation practice in Central Florida, a passenger occupies the rare position of having no realistic share of the blame, so the argument that consumes most collision claims never gets started, and what actually determines the outcome is identifying which policy responds and documenting the injury early enough that causation is not arguable later. Because Florida now allows two years from the date of a negligence claim to bring suit and out-of-state visitors often lose the first several weeks to travel and follow-up care at home, counsel for motor vehicle collisions in Orlando tend to press for the crash report and the ride records well before treatment has finished. Documentation That Exists Only If You Create It Photograph the vehicle: plate, any company name, and any permit or medallion decal on the door or windshield. That decal is often the fastest way to tell later whether you were in a cab or a private car being used as one. Note how the ride was arranged, because you are the only person who can establish that. If an app was used, screenshot the trip record with the driver's name, the vehicle and the timestamps before closing it. Get the crash report number at the scene, then obtain the report itself through the state's traffic crash records system. Read it when it arrives, since reports routinely misidentify which occupant was which, and a correction is far easier in the first weeks than a year later. And be seen by a doctor before flying home if there is any doubt, even briefly. A same-day record from the city where the crash happened is worth considerably more than a first visit two weeks later in another state.
